
With regard to Elizabeth C. McNulty a personal injury attorney employed with the Simon Law Firm P.C. - Mo. Bar # 72026 Elizabeth McNulty made her appearance on behalf of plaintiff client Albert B. Pepper Jr. on the date of June 30,2023 in the matter of Pepper v. Gelfand case # 19SL-CC04680 which was tried in the 21st. Judicial Circuit after the withdrawal of Anthony R. Friedman - Mo. Bar # 65531 and his departure from The Simon Law Firm P.C.

Within the context of these next several pages I am going to unpack for you and for your consideration the attorney - client relationship and dynamics that had become increasingly toxic after McNulty was appointed to dispose of the mess that Anthony R. Friedman created and the continuation of professional misconduct and multiple rule violations that is the purpose of a forth coming complaint to be filed with the Office Of Chief Disciplinary Counsel of the Supreme Court of Missouri. Multiple acts of nonfeasance, misfeasance and malfeasance perpetrated upon her client Albert B. Pepper Jr. and how the Model Rules of Professional Conduct, the violation thereof, apply. The O.C.D.C. complaint will follow a very simple formula. Allegation, rule citation, supporting evidence. It will be a similar pattern to the complaint filed by Albert B. Pepper Jr. naming Anthony R. Friedman as respondent that was delivered to the O.C.D.C. in Jefferson City, Missouri on December 22, 2025 and is pending investigation.
The formal complaint alleging violations of the rules of professional conduct committed by Elizabeth C. McNulty are not an isolated incident but rather, demonstrate a pattern that began on June 30, 2023 and continued until her withdrawal of representation on February 29, 2024.
The evidence for submission to the O.C.D.C. and for consideration that will support that allegations of violations are quite comprehensive. Specifically, telephone conversations between Pepper and McNulty, e;mail correspondences, witness depositions, court transcripts and case file which will be extremely difficult for McNulty to defend against if, the O.C.D.C. opens an investigation based upon the merits of the complaint.
Herein is a preliminary summary of the Model Rules of Professional Conduct (presented in a social media format) I will be citing and as I continue to aggregate the evidence upon a time line between the dates of entry of appearance by McNulty and withdrawal of representation by McNulty the complaint will be more comprehensive in scope.

In conclusion. The various acts on nonfeasance, misfeasance and malfeasance and associated vilolation fo the rules of professional conduct that began with the representation of Anthony R. Friedman who I referred to as the Proto-Malfeasor perpetuated upon his client Albert B. Pepper Jr. continued with the misconduct of Elizabeth C. McNulty who I now refer to as the Successor Malfeasor.
Furthermore, both of these bad actors performed these various acts of misconduct while under the employ of The Simon Law Firm P.C. with whom I retained for representation. John G. Simon Mo. Bar # 35231 principal. who knowing of my dissatisfaction with how the case was being handled failed to provide a remedy and the conclusion of the case was that the plaintiff, Albert B. Pepper Jr. who they represented realized a net $0.00 recovery his injuries after five years of litigation. John G. Simon is vicariously liable both in a professional misconduct and civil tort context for the misconduct of the attorneys under his employ.
