This is an advisory sent to the American Inn of Courts with regard to the consideration or retention of Elizabeth C. McNulty Mo. Bar # 72026 as a barrister member and provides the counter-narrative to the gratuitous peer recommendations that often presents within the Saint Louis legal community that have little to no tangible credibility or foundation.

It is alleged that the prodigious public relations modality of the employer The Simon Law Firm P.C. creates an unsubstantiated credibility without warrant and contrary to the subjects legal acumen. Beyond the p.r. veil the substance of the subject is without form and void.

With regard to Elizabeth C. McNulty Mo. Bar # 72026 being currently employed with the Simon Law Firm P.C. in St. Louis, Missouri and her candidacy for Barrister Member of the Theodore McMillian Chapter of the Inns of Court.


Please be advised that the documented acts of professional misconduct in violation of the Missouri Model Rules of Professional Conduct (Rule 4) are the foundation of a formal complaint to be filed with the Office of Chief Disciplinary Counsel of the Supreme Court of Missouri for investigation naming Elizabeth C. McNulty as Respondent.


Furthermore, Elizabeth C. McNulty acting as successor lead counsel in a medical malpractice complaint titled Pepper v. Gelfand M.D. case # 19SL:-CC04680 that was tried in the 21st. Judicial Circuit of St. Louis County Missouri presented with well documented acts of nonfeasance, misfeasance and malfeasance that McNulty perpetrated upon the plaintiff client Albert B. Pepper Jr. that is the merit for a forthcoming legal malpractice complaint to be filed by Pepper naming The Simon Law Firm P.C., Elizabeth C. McNulty et al. as defendants. 


A letter to preserve evidence / spoliation demand, was sent to The Simon Law Firm P.C. by the Movant Albert B. Pepper Jr. on June 17, 2024 advising The Simon Law Firm P.C. et al. that litigation was imminent. Missouri Statute: RSMo §516.120 provides for five years from the date that the injury is realized for a deadline to file a complaint. 


Yet further, because of these act(s) of the violation of the rules of professional conduct, the tortious acts of nonfeasance, misfeasance, malfeasance, the systemic pattern, egregiousness of the acts and the injury realized by the client for which McNulty provided representation the client is now engaged in a consumer advocacy and citizen journalist capacity to make public declaration of this conduct that serves the public interest. 


Albert B. Pepper Jr. formed and registered with the Missouri Secretary of State: Phoenix Rising Products LLC and a consumer advocacy website: Shout It Out Loud  https://shoutitoutloud.org/ featuring Elizabeth C. McNulty and her conduct as counsel as a “case study” and is a primer for the solicitation for any and all aggrieved parties by the acts of professional misconduct and tortious malpractice to archive their complaint. 


The rhetorical question I would ask the current members of the Courts of Inn in consideration of  Elizabeth C. McNulty as a barrister member is: Does Elizabeth C. McNulty as a licensed attorney, her presentation, conduct and verifiable results as a counselor and sworn office of the court merit inclusion or is it based upon the unsubstantiated gratuitous accolades of legal peers void of foundation that is endemic of the Saint Louis legal community. 


In conclusion, I, Albert B. Pepper Jr. would suggest that in consideration of Elizabeth C. McNulty as a barrister member of the Inns of Court and that specifically for the Theodore McMillian chapter in St. Louis Missouri or continuation as a member that it may be well advised to consider how the controversy and the well documented prima facie evidence that supports the allegations would impact the integrity of the Inns of Courts.
